China’s South China Sea Strategy: Simply Brilliant

In the past 12 months, China has provoked considerable attention with its reclamation activities in the South China Sea, particularly in the Spratlys where it controls seven maritime features.

China’s history of salami-slicing presents a dilemma to regional countries as well as external powers with regional interests: do they escalate an incident each time China slices the salami and risk open conflict, or stand down and allow China to augment its territorial claims.

The million-dollar question remains: who or what will freeze China’s reclamation in the South China Sea? The answer: nothing, really.

It has been proposed, for example, that like-minded states carve out a ‘code of practice’ that would stress the rule of law and mirror the 2002 Declaration on the Conduct of Parties in the South China Sea. Another option being considered by the Pentagon is to send US aircraft and ships within 12 nautical miles of the Chinese-built reefs in the Spratlys, to challenge its influence there.

While useful, such proposals won’t freeze or rollback China’s attempts to change the facts on the ground (or the high sea). China’s reclamation seeks to pre-empt any decision that would come from the Philippines’ challenge in the International Tribunal for the Law of the Sea over China’s nine-dash line claim to the South China Sea.

It’s noteworthy that China hasn’t only engaged in salami slicing; it has sought to use the attraction of its economy, trade and aid to offset its high-risk behaviour.

Following the 2012 Scarborough Shoal incident with the Philippines, China launched a charm offensive in 2013, wooing ASEAN with a treaty of friendship and cooperation, stressing that it intended to take China–ASEAN relations from a ‘golden decade’ to a ‘diamond decade’.

This year, when concerns about China’s reclamation have intensified, China has offered a carrot: US and other countries would be welcome to use civilian facilities it’s building in the South China Sea for search and rescue and weather forecasting, when ‘conditions are right’.

China has also used its economic weight to deftly tilt the balance (of influence, at least) in its favor. Its Asian Infrastructure Investment Bank (AIIB) is attracting long-standing American allies such as Great Britain, Australia and South Korea. China has stolen a march on the US in the battle to win friends and influence people.

And the economic offensive doesn’t end with the AIIB. The Regional Comprehensive Economic Partnership—a free trade agreement that would involve ASEAN, Australia, China, India, Japan, New Zealand and South Korea—is seen as a rival to the US-led Trans-Pacific Partnership. China’s Silk Road Economic Belt is also another lure for peripheral countries keen on leveraging on China’s economic ascent.

Concerted and effective opposition to China’s fait accompli in the South China Sea requires an astute mix of diplomacy and deterrence. It might take the form of a regional effort to get China to clarify its nine-dashed line claims based on UNCLOS principles, an ASEAN ultimatum for China to at least freeze its reclamation activities, and joint ASEAN–US patrols near the reefs being reclaimed by China. This looks unlikely to emerge anytime soon.

ASEAN was damaged in 2012, when it failed—for the first time in its 45-year history—to issue a communiqué due to differing views over the South China Sea. ASEAN has recently upped its game by underscoring the dangers of China’s reclamation, but there’s little the group can do apart from pushing for a formal Code of Conduct. A successful conclusion of the code isn’t assured; China dangles the carrot of code negotiations to buy time even as its carries out reclamation.

For all its rhetoric about the need to uphold international law and the freedom of navigation, the US is conflicted when it comes to China. It all boils down to this: will the US risk its extensive relationship with China over a few rocks in the South China Sea? As Hillary Clinton once said: how does the US ‘deal toughly’ toward its banker?

To get a sense of the effect of China’s creeping invasion of the South China Sea, one only need look at Vietnam. Faced with China’s challenge to its claims to the Paracel Islands, Vietnam has purchased Kilo-class submarines, reportedly armed with sub-launched land-attack Klub missiles that could threaten Chinese coastal targets. But Vietnam didn’t fire a shot when China towed a US$1b oil rig into waters claimed by Vietnam last year. On a recent trip to Hanoi, Vietnamese scholars told me that Vietnamese military officers urged sterner action, such as firing on Chinese ships, but senior leaders vetoed them, instead deciding to sit back and let China incur ‘reputational damage’.

Not many people in Asia would agree with what China is doing in the South China Sea. But as it stands, China’s strategy—salami slicing, using offsets to soften risky behavior and accelerating its reclamation activities in the absence of significant opposition—can be summed up in two words: simply brilliant.

Coast Guard Budget Battles Revisited

Why does the Coast Guard seem to be losing the budget battle within the Department of Homeland Security (DHS)? While funding for the Department has grown, the Coast Guard budget has in fact declined in real terms. I suspect it has a lot to do with perceptions of a miss-match between DHS missions and Coast Guard missions.

Congress attempted to address this perceived mismatch in the Homeland Security Act of 2002 by requiring an annual report of resources allocated to DHS missions and non-DHS missions, to ensure non-DHS missions are not ignored. I will refer to this “Annual Review of  the  United States Coast  Guard’s  Mission  Performance” (pdf) as the Performance Report.

It is an interesting report, but it does have significant weaknesses, largely stemming from the use of undifferentiated and undefined “resource hours” as a measure of effort. I reviewed a report back in 2010 and offered my criticisms, which have not changed herehere, and here.

Unfortunately, I think this report may be part of the problem, in that it defines several Coast Guard missions as “non-DHS,” and it gives the impression, erroneously I believe, that roughly half of the Coast Guard’s budget goes for things outside the DHS charter.

Of the eleven Coast Guard missions, six were regarded as Non-Homeland Security missions: SAR, AtoN, Living Marine Resources, Marine Environmental Protection, Marine Safety, and Ice Operations.

The five Homeland Security missions are Ports, waterways, and coastal security, Drug Interdiction, Undocumented Migrant Interdiction, Defense Readiness, and Other Law Enforcement (primarily Foreign Fisheries Enforcement).

But these distinctions are fallacious.

The Department views its own missions as:

  1. Preventing Terrorism and Enhancing Security
  2. Securing and managing our borders
  3. Enforcing and administering our Immigration laws
  4. Safeguarding and securing cyberspace
  5. Ensuring resilience to Disaster

NON-DHS MISSIONS: All these missions, at least in some respects, support DHS missions.

SAR: A robust SAR organization is clearly a necessary foundation for “Ensuring resilience to Disaster.” What were Katrina and Sandy but huge SAR cases? SAR command posts and communications are the skeletal structure upon which Disaster Response is based. After all, every SAR case is really a response to a disaster of some dimension. If the 3,000 plus people the CG saves every year had died in a single incident, it would have been a disaster on the order of 9/11.

AtoN: Most of the population lives near the coast or inland waterways. Most depend heavily on marine transportation and in many cases fishing. When there is a disaster, restoring safe navigation is a high priority both for bringing in assistance and for recovery.

Marine Environmental Protection (MEP):  The Deepwater Horizon was a disaster. MEP regulation attempts head off disasters and mitigate its effects, that is “ensuring resilience to disaster” plus offshore and port-side energy infrastructure are potential terrorists targets.

Marine Safety: Marine Safety is designed to prevent marine disasters. A sunken cruise ship could be a disaster on the order of 9/11. Marine Safety standards tends to mitigate the effects of a terrorist attack on marine targets

Living Marine Resources: Destruction of valuable marine resources can actually be as disaster for the economy of some communities.

Ice Operations: Domestic icebreakers can prevent flooding. We recently had a case where a community in Alaska would have been left without fuel, if an icebreaker had not opened a path for delivery.

THE UNLISTED COAST GUARD MISSION:

Safeguarding and securing cyberspace: It is not one of the Coast Guard’s eleven statutory missions, but this is in fact one of the Commandant’s key priorities. Still it is not addressed in the Coast Guard’s annual Performance Report.

THE NON-DHS DHS MISSIONS: Two missions listed as DHS missions in fact are of little interest to the department, and performance goals (which are themselves perhaps inadequate) in these two areas are not being met.

Defense Readiness: Apparently the Coast Guard is doing more for Defense Readiness now than it was before 9/11, but really little has been done in terms of adapting resources for wartime roles. Additionally, a potentially major Coast Guard contribution to defense readiness, the major cutters, are being replaced at such a slow rate, the fleet continues to age, making it less reliable.

Other Law Enforcement (primarily foreign fisheries): DHS probably has little interest in this. This mission also suffers from the aging of the cutter fleet, and additionally the very large US EEZ in the Western Pacific has been largely ignored.

Problems in DHS: I do think the Departments placement of priority on counter-terrorism over more general disaster response is misplaced,  and this is another source of problems.

CONCLUSION:

I will quote my closing paragraph from my 2010 post,

When it comes time to decide the Coast Guard budget, I would suggest Congress take a different approach. Consider return on investment. If you like the return you are getting from the Coast Guard now, invest more.  Don’t say, “Agency ‘X’ isn’t working, we need to put more money into that.” “The Coast Guard, is doing a good job with their current budget so we don’t need to give them any more.” I don’t quote scripture very often. I’m not religious, but there is some wisdom there. Check out the story of the “good and faithful servant” Matthew 25:14-30.

Naval Build-Up in the Philippines

Like many of its regional peers, the Philippines is in the midst of a defense buildup, motivated in no small part by China’s assertive moves in the western Philippine Sea and the resource-rich Spratly islands. 
              
The donation this week of two Balikpapan-class Landing Craft Heavy (LCH) from Australia was the most recent boost to Philippines defense efforts. 
        
The LCH donation is particularly timely, as it complements the upcoming pair of Strategic Sealift Vessels (SSV), being built by PT PAL Indonesia. Based on the Indonesian navy’s successful Makassar-class Landing Platform Dock (LPD), the 8,600-ton amphibious lift ships can transit to remote areas and serve as a mobile base for helicopters and smaller landing craft. As evidenced during Typhoon Haiyan, the dearth of such assets hampered the Philippine government’s aid response to the hardest-hit parts of the country. 
          
As gifts stand, the donation of ex-HMAS Tarakan and Brunei is particularly generous – the Royal Australian Navy will hand them over fully refurbished with new safety and navigation components, plus spare parts packages. Manila is considering purchasing the three remaining LCHs as well. 
       
While the media focus of Manila’s defense acquisitions under the Capability Upgrade Program has been centered on big-ticket items to restore basic conventional force capabilities, there have been other, quieter acquisitions that directly support war-fighting and maritime domain awareness (MDA). 
         
Notably, the service signed a Memorandum of Understanding in 2014 with the Philippine National Oil Company to transfer three retired 2,500 ton petroleum tank ships. This acquisition would enable fuel replenishment at sea and increase on-station time for high-endurance assets like the patrol frigates Ramon Alcaraz and Gregorio Del Pilar, both formerly U.S. Coast Guard Hamilton-class cutters.  
Another low-profile capability is the National Coast Watch Center program—a surveillance system designed to monitor oceanic traffic in the western Philippine Sea.
              
As expected, details of this national intelligence capability are closely held, but much of it is likely based on the successful implementation of the earlier Coast Watch South program. With heavy U.S. assistance, the Philippines created a network of monitoring stations combining radar, maritime surveillance and radio/data networks that provides a real-time strategic and tactical “picture” of oceanic traffic in the Southern Philippines—the so-called Sulawesi Sea Triangle. That area is a hotbed of illicit trafficking by sea and a favored logistical trail for transnational insurgent forces that prowl the region. When completed in 2015, the west-facing Coast Watch chain will monitor the Philippines’ Exclusive Economic Zone (EEZ), extending 200 nm into the contested Spratly Islands group. In the future, additional monitoring chains will cover the Northern and Eastern facing portions of the country as well. 
           
The most recent, visible and well-publicized modernization program has been the integration of the multipurpose helicopter program with the patrol frigate force. Five Augusta-Westland A109s twin-engine helicopters equipped with forward-looking infrared have been delivered to the fleet to replace long-retired BO-105s. From an operational perspective, the navy has made quick strides to integrating the air asset with ships of the line. The AW109s had a maiden deployment on board Ramon Alcaraz during the Australian multinational military exercise Kakadu 2014, approximately eight months after receiving the first helicopters. 
          
Out of all the projects to restore capabilities, the navy is still awaiting final determination of its premier acquisition – the multi-role frigate. The Philippines wants to buy two units to serve as major and modern combatants of the patrol frigate force. While the negotiations have been stymied by a complex two-phase process, a list of qualified bidders has emerged, including well-known Spanish shipbuilder Navantia and several South Korean firms, among others. A winning bid was to be selected in late 2014, but the acquisition process reportedly has been complicated by efforts to separate the tracks of selecting a ship from the embedded weapon systems. This may have to do with current challenges of the Philippines not being easily cleared for purchases of regional-balance changing weapons, such as a long-range surface-to-surface missile, with which this ship class is normally equipped.  
          
The Armed Forces of the Philippines has benefited under President Benigno Aquino III’s administration. To date, multiple modernization programs have either reached significant acquisition stages or have been completed entirely during his tenure. 
         
However, as the new paint smell wears off for the navy, the historical challenges that have haunted its past acquisitions and programs loom. It is critical that the next presidential administration continue to support the acquisitions, as well as the services, both politically and fiscally. The navy needs to ensure that internal expertise among the ranks to maintain their newly acquired equipment is present and sustainable. Above all, operating effectively and efficiently at sea continues to be the primary objective. The nation’s seafaring history and ties to the maritime culture give impetus to the current goals of ensuring territorial integrity and establishing a credible defense. Given the relatively rapid pace of modernization, the Philippine navy is well on the road to restoring the capabilities necessary to meet those demands.

Staying Ahead of the Arctic Thaw

Based on the warming trend in the Arctic Region, large portions of the Arctic Ocean are projected to be seasonally ice free by mid-century; between 2030 and 2050.  This warming trend carries with it the risks and opportunities associated with seasonal access to the Arctic Ocean, rivers, and coastline which includes mineral deposits, petroleum resources, fishing stocks, and economically advantageous shipping routes.  The central question is how the United States should prepare for the effects of a potential seasonal thaw of Arctic ice by mid-century.

US National Interest

Seasonal access to the Arctic Ocean significantly impacts US national interests.  It has the potential to increase national economic security, encourage global economic stability, and create new theaters for global leadership in international cooperation.

arctic1The Arctic region is estimated to have over $1 trillion worth of precious minerals and the equivalent to 812 billion barrels of oil.  All of which will become increasingly available for extraction.  The U.S. could make great strides toward energy independence by developing these resources within its Arctic territory and Exclusive Economic Zone (EEZ).

Actors and Governance

1.         Actors

The actors involved in strategic prepositioning for the Arctic thaw fall into two categories.  The Primary Actors hold legal rights to Arctic territory in accordance with internationally accepted legal structures.  These include the Arctic Nations (United States, Russia, Canada, Iceland, Norway, Sweden, Finland, and Denmark) and indigenous populations (Athabasca, Inuit, Saami, etc.).  Influential Actors have significant stakes in Arctic policy outcomes but do not hold legal rights.  While some such actors may not yet be apparent, the most obvious are large environmental advocacy groups and multinational corporations in the energy, mining, shipping, and fishing industries.

2.         Governance

Governance in the Arctic Region, particularly the maritime domain, remains in nascent form.  The United Nations Convention on the Law of the Sea (UNCLOS) broadly applies international law but does not address unique requirements for Arctic shipping.  For example, there are no ship construction specifications or crew proficiency requirements for sailing within proximity to ice fields.  Under the United Nations charter, the International Maritime Organization has begun to analyze potential Arctic regulatory actions.

The Arctic Council was established in 1996 as an intergovernmental forum to coordinate Arctic policy and resolve disputes diplomatically. This forum does not establish international law but provides a venue for Arctic Nations to settle bilateral or multilateral disputes as well as coordinate initiatives to be brought before the International Maritime Organization.

At the national level, laws pertaining to environmental protection and the rights of indigenous peoples produce a complicated legal landscape the policy makers will have to navigate in coming years.  Shell’s recent decision to postpone drilling operations in the Alaskan Arctic highlights this tension.

Considerations

1.         Unclear Impacts of the Thaw

While a seasonal ice-free thaw by mid-century is generally accepted, several second order effects remain controversial or unpredictable.  The total magnitude of shipping traffic, intensity of mineral and oil extraction, as well as weather impacts on fishing stocks and agricultural growing conditions are not commonly understood.

arctic2Most shipping estimates focus on the economically viable trans-Arctic shipping traffic between North Asia and Europe.  By 2030, 1.4 million TEU (twenty-foot equivalent unit) could be transported across the Arctic on 480 total transits.  By 2050, a potential 2.5 million TEU could be transported across the Arctic on 850 total transits.  The wide array of other potential waterborne activities (i.e., commercial fishing, offshore drilling/exploration service traffic, and tourism) is not adequately captured in shipping estimates.

The Arctic warming trend could increase fishing stocks and shift populations northward, thus bringing with it commercial fishing fleets.  This trend also may improve agricultural growing conditions across the Siberian plain and allow waterborne bulk transport of product via Arctic rivers.  All of these activities could sharply increase the seasonal shipping density in the Arctic.

2.         Delicate and Extreme Environment

The Arctic is an extremely fragile ecosystem.  The risk of ecological disasters associated with resource extraction and transport will greatly impact the legal framework as well as rate and costs of development for exploitation of Arctic natural resources.

Human disasters will be just as likely.  As Arctic infrastructure and maritime traffic increases, so increases the need for responding to human distress.  Relief or Search and Rescue efforts in a region with significant radio interference and decreased satellite and GPS coverage will require a multi-national collaboration.

Policy Path Options

The United States can choose from three policy paths: a market-led policy, a regulatory-led, or a blended policy.  A market-led path would place the government in more of a reactionary role by regulating as industries develop.  A regulatory-led path would establish constraints or enablers ahead of industry to guide market development.  The blended path would regulate areas of critical priority ahead of industry but otherwise allow the markets to develop naturally.

Potential Naval Efforts

While national policy seeks to minimize the militarization of the Arctic, the United States Navy could still play a significant role in the development and organization of Arctic maritime shipping management.

1.         Lead an Interagency effort to develop infrastructure and regulations to ensure safe navigations of Arctic waters.

At the national level, the Navy could identify site and asset requirements for comprehensive Maritime Domain Awareness across all U.S. arctic territory and EEZ to include weather and ice forecasting suitable for navigation.  Once these requirements are identified, the Navy could lead efforts to construct a Memorandum of Understanding (MOU) with the U.S. Coast Guard, the National Oceanic and Atmospheric Administration, and the Bureau of Ocean Energy Management in order to develop definitions of roles and responsibilities as well as set the framework for burden sharing agreements.

2.         Develop multilateral opportunities to enhance disaster response.

At the international level, the Navy could lead the effort to build an increasingly complex set of Search and Rescue and Emergency Response training exercises that include multiple U.S. agencies as well as those from other Arctic Nations.

The aforementioned efforts would ultimately lead to the development of an International Arctic Management Center.  This center, with operational nodes near the Bering Strait and Iceland-UK Gap, would be multinational and interagency in nature.  The primary roles of this center would be to manage safe shipping transit throughout the Arctic and coordinate multinational emergency response efforts.  Management of shipping would include organization of convoys as well as activation and dynamic adjustment of approved shipping corridors based on traffic density, weather, and ice.

Proactive international management of commercial activities in the Arctic will greatly reduce the risk of catastrophic events and improve response to those that occur.  Additionally, coordination efforts stand to strengthen cooperation and relations across all Arctic and participant nations, including Russia.
