Russia, Syria, And Refugees: Policy from a Systems Perspective

Let’s briefly discuss the Russian expeditionary force in Syria and the European refugee crisis, because from a systems standpoint they are both emanations of the same phenomenon.

The great challenge of international relations and national security is to maintain a system in being: specifically, defending a global order presided over and more or less guaranteed by the United States, while preserving a toleration for the inevitable dynamism of that system. American hegemony will not last if it is expressed as a frozen status quo, nor if it sees an absence of American engagement. The problem is that American policymakers understand this rather poorly.

Two sorts of arrogance have characterized the American approach to this systemic-preservation imperative in this century. The first was the belief that American systemic hegemony was sufficient to impose outcomes on individual subsets of that system without accounting for their own dynamism. This brought us the outcomes we saw in Iraq and Afghanistan. The second, succeeding the first and in reaction to it, was that American systemic hegemony on its own — absent deliberation and engagement — was sufficient to defend America and its core interests from the consequences of unattended disorder in those same subsets of the system. This brought us the outcomes we see in Syria and Europe, and deserves some exposition.

Both types of hubris were on display in the September 2013 Syrian crisis, in which the President of the United States first declared that America would make war on the Assad regime (type one, determinative arrogance), and then declared that it was not necessary to make war on the Assad regime (type two, the arrogance of self-sufficiency). Having declared enmity against a power engaged in an existential struggle, and then having failed to act upon that enmity, the United States reaped all the disadvantages of antagonism with none of the potential advantages. One specific disadvantage it relinquished was the friendship of that power’s own enemies, all of whom perceived that alliance with the Americans would yield no positive outcomes. Those enemies instead turned to perceived-effective foes of that power, among whom the radical Sunnis of Al Qaeda and (arguably worse) ISIS emerged as chief. Further muddying the waters have been American efforts to placate the Assad regime’s major ally and sponsor in Iran, guaranteeing that no anti-Assad force in its right mind will trust us — and in fact many believe we are secretly in league with their antagonists.

The outcomes in Syria ought to be a testament to the futility of existing policy. Disorder in the system, left unattended, has spread as entropy does. The Assad regime, once perceived as the worst player in the region — or the system’s local minimum — is now arguably the best, and inarguably not the worst. Disengagement has completely failed for all parties, as disorder emanates to Europe in the form of refugee flows, and to America as a challenge to its hegemony with the dispatch of a Russian expeditionary force. The refugee crisis is a rebuke to the Europeans, who pay the price of freeloading off an American-led order (and therefore suffer when the Americans refrain), and also (along with the Greek crisis) seen their continental union project exposed as mostly a superstructure for the benefit of elites. European separation from the broader system has failed. Similarly, Americans are learning that their disinterest in war does not diminish war’s interest in them.

It is worth noting that the Russian expeditionary commitment to Syria may be, given visionary strategic leadership, a master stroke. (That given is of course not a given where the Russians are concerned.) The narrative roles the Russians have the potential to fill are a cornucopia of goodwill-generating engagements: defender of Christians, destroyers of ISIS, vigorous great power, guarantor of order, ender of refugee flows, et cetera. Every single one of these narrative roles is in direct contrast to American and European actions (or more properly inactions), and have the added benefit of likely commanding the sympathy of significant minorities within both populations. Russia is not well-equipped to pacify a fractious nation of 20 million people — but it is eminently qualified to ruthlessly crush a local faction, and that is all that matters here. A task leveraging the player’s strengths with such massive prospective benefits embedded in the narrative flaws and faulty assumptions of strategic rivals is either the result of strategic genius — or stupefying luck.

Here’s the bottom line: both conceits that have governed the American approach to foreign engagement are false. Entropy extends throughout systems, and one does not get to secede from them as situations demand. We cannot impose control upon dynamic systems. Nor can we secede from those systems and their effects. We are all part of a gigantic meta-system, as a nation and a people, and so our charge is to see to its continuance. That does not mean decisive engagement or disengagement. It means entanglement and — this is unpopular and opaque — maintenance. It means we venture abroad, not to decide and direct, but to contend and affect. It means that sometimes the choice is between dangerous great-power opportunism and catastrophic migrations on the one hand, and desultory and interminable expeditions to strange lands on the other.

This is the logic of hegemony and the nature of systems, and it is therefore what we must do. The tragedy is that a democratic society bottle-fed a narrative of “progress” is increasingly unable to do it.

The logistical side to the US Pivot to the Pacific. One of the aspects not often discussed of the US “Pivot to the Pacific” is that it is not just combat forces (US Army, US Air Force, US Navy and US Marine Corps) moving, but also the Military Sealift Command, which constitutes the cornerstone of logistical support for US operations all over the world. Just to get an idea of its size, if this command’s ships belonged to another nation they would be the fourth-largest navy in the world. As a consequence, NATO European members must reinforce their logistical capabilities.

The best-prepared naval forces to achieve this are the Royal Navy (the Royal Fleet Auxiliary, to be more precise) and France’s Marine Nationale. Germany is beginning to boost her global-scale force projection capabilities, limited to date due to well-known historical reasons. Now, the economic crisis and ensuing budget cuts are providing added impetus to the development of shared capabilities. While there is a growing pressing to achieve this, it is nothing new. For example, we can mention the United Kingdom and the Netherlands as a model of force integration, with their UK/NL Landing Force. By the way, there is a Catalan angle to this. Anglo-Dutch cooperation in amphibious operations dates back to the 1704 landing in Gibraltar, where a 350-strong Catalan battalion under General Bassett also took part. Therefore, should a future Catalan contingent join the UK/NL Landing Force, they would just be coming back home. Another significant example are the three Baltic Republics, which combine their naval forces in the BALTRON (Baltic Naval Squadron).

Barcelona and Tarragona Harbours: two key dual-use infrastructurs in the Western Mediterranean. When we talk logistics, one of its key elements are ports. It is precisely when countries are pondering how to cut costs that the concept of dual-use infrastructures comes to the fore. In this area, the ports of Barcelona and Tarragona can make a much greater contribution that they do at present. Right now, other than the occasional port visit by the US and other Allied navies, they are not the permanent home of any Spanish Navy unit. Furthermore, despite healthy growth in terms of tonnage, much of their necessary connecting infrastructure remains incomplete. In particular, a European gauge connection to the French railway network. However, in addition to featuring in plans for a future Catalan Navy, they could also become an strategic asset for NATO, being home to a portion of the Atlantic Alliance’s logistical units in the Mediterranean Theatre.

It is not just a matter of size. Both infrastructures are located in areas sporting a concentration of industry and transportation links. These links must certainly be improved, in line with the EU’s 2013 decision to confirm the “Mediterranean Corridor” as a key element of the Old Continent’s transportation networks. This label refers to a railroad transportation axis connecting cities and ports along the Spanish southern and eastern seaboards to France. Since most EU member states also belong to NATO, there is no reason to expect any discrepancy between the two organizations when it comes to the logistical map of Europe.

The benefits on the civilian economic front of completing this infrastructure have already been explained at length by myriad economists, such as for example Ramon Tremosa, currently serving as member of the European Parliament, who has written extensively on the project and worked hard as a lawmaker to see it come to fruition. This explains the support of the French Government and the European Commission, which have rejected alternative proposals to drill a tunnel in the Central Pyrenees, connecting Spain and France through the Aragon region. From a naval logistics perspective, this alternative plan would not have benefited NATO and allied navies to the same extent, since it would have meant bypassing Tarragona and Barcelona. The benefits of the “Mediterranean Corridor”, on the other hand, also extend to the field of defense. For example, should NATO’s Response Force (NRF) need to project one of its battle groups in a crisis scenario, we may ask ourselves whether Toulon, Marseilles, and Naples harbors would suffice. While it would not be impossible, it may make it harder to label it a rapid-reaction force.

The Pivot to the Pacific rests on a strong NATO and a secure Mediterranean. The US Pivot to the Pacific, and more widely the growing coordination among the maritime democracies in the Indian-Pacific Ocean Region, are based on the assumption that the Mediterranean will be secured by NATO. Thus, any move reinforcing security in this body of water has a direct, positive, impact on the struggle for the rule of law at sea in the Indian-Pacific Region. A struggle, let us be realistic about it, that is surely to be bitterly tested in the future ahead. As a historical reminder of the connection between the two regions, we may mention the failed British strategy to defend Singapore. Built at a time of scarce resources, the naval base was supposed to provide the necessary facilities for a strong naval and air force to be moved in the event of a crisis, without the expense involved in a permanent presence. However, the need to protect home waters, the Atlantic, and the Mediterranean, meant that all that London could send were HMS Prince of Wales and HMS Repulse, sunk by Japanese land-based naval aircraft in the South China Sea in the opening days of the Second World War in the Pacific.

Conclusions. Barcelona and Tarragona are key dual-use facilities in the Western Mediterranean, whose naval logistical potential to date has not been fully exploited. Their worth will multiply once the “Mediterranean Corridor”, backed by Paris and Brussels, is completed. Their potential contribution to NATO is growing as pressure on defense budgets forces countries to get as much bang for the buck as possible, and as moves to reinforce the Indian-Pacific Ocean Region make it imperative to fully secure the Mediterranean.

Peter Fitzsimons. Gallipoli. Random House Australia, Feb 01, 2015. Hardcover. 800 pages. $45.00.

When writing about World War I, it can be difficult to strike the correct philosophical balance. Make the story too bleak or nihilistic and you risk misunderstanding the very real patriotic enthusiasm that characterized the first months of the War. Conversely, one can’t make the story too romantic and heroic at the risk of ignoring the fact that most of World War I was a brutal slog with moments of individual gallantry, often overwhelmed by pointless slaughter exacerbated by terrible generalship.

World War I had so many different facets that it can be hard to meld the stories of political scheming in London, Berlin, and Constantinople with the existential drama of soldiers clinging to their lives in trenches under constant enemy fire while waiting for the order to ‘fix bayonets’ and go over the top. Simply put, most stories of World War I don’t scale well: they work best as individual stories (depending on your temperament I recommend either Storm of Steel or the equally classic All Quiet on the Western Front) or sweeping grand histories (my favorite one volume is the comparably slim The World Undone or Robert Massie’s Dreadnaught and Castles of Steel combination for the nautically inclined). Rarely does a history come along that can fuse the two genres. That’s why Peter Fitzsimons’ masterful new volume Gallipoli is such a treat.

The task of the Allies at Gallipoli was truly Sisyphean. They held the low ground: thin trenches carved into the sides of steep cliffs, downhill from the Turkish trenches, exposed to artillery fire. A few times a month they were

directed to fix bayonets and, often in the cover of darkness and always over terrain with minimal cover, take the hill and break the Turkish lines. It was an impossible task. After over a year of grinding attrition from disease and enemy fire, the Allied troops were withdrawn in secret, in good order and with no casualties. The Gallipoli peninsula was ceded to the Turks.

How did it all go so wrong? Despite opting to spend most of the book with the ANZAC (Australian and New Zealand Army Corps) troops in the trenches, Fitzsimons does an admirable job decoding the mix of over-optimism, managerial muddle, and lack of appreciation for local conditions that combined to make an Allied amphibious landing in Gallipoli seem like such a good idea… at least to those sitting in London. A young and manic Winston Churchill, then First Lord of the Admiralty, speed walks through Whitehall, obsessed with finding a way to use the Royal Navy to end the grinding stalemate on the Western Front. His genius brainwave? Send a flotilla of minesweepers and battleships up the Dardanelles and onward to Constantinople to scare the Turks into surrender. Had that plan worked it would have stood as history’s grandest example of gunboat diplomacy.

But the plan didn’t work. The Ottomans and their German advisors mustered just enough of a defensive effort, using a combination of minefields and artillery, to drive back the minesweepers and batter the fleet. Churchill was forced back to the drawing board, eventually convincing the Army to support the Naval force with an amphibious landing on the Gallipoli peninsula. became a joint Army-Navy invasion. Until the following year’s Allied withdrawal from the peninsula, the Army was to take the brunt of the punishment, with the Navy providing mainly logistical support and transport with the occasional desultory gunfire support to ground operations.

What redeems the story of this quagmire is the piss, vinegar, and rude good humor of the ANZAC soldier as he departs home for the first time, trains for combat in Egypt under the nose of the Sphynx, disembarks on the coast of the Peninsula during the cold predawn hours, and scrambles up the hill again and again as Allied fortunes slowly dwindle and the bodies of his friends pile up around him. Though the story has many individual heroes on both sides (Fitzsimons has a deep respect for the tenacious Turks, enduring stoically in conditions at least as poor as those of the Allies), it is the archetype of the ANZAC soldier that shines through most brightly.

The first third of book covers the transportation and training of the ANZACs and culminates in the shock of their initial (opposed) landings. It reads like a nineteenth century boy’s adventure novel. Everything is bustle and forward motion; the world outside Australia is crammed with dangerous and seductive wonders. The reader is invited to stand among the troops and stare in awe as their transport ships glide quietly up the Suez Canal at night. Later, as the ANZACs train and assemble for the invasion in Alexandria, the story briefly becomes a cautionary tale about the dangers of allowing relatively well paid young soldiers unfettered access to Egypt’s renowned brothels. Letting the reader get to know and love the jovial ANZACs before hurling them on the beaches of Gallipoli is a painful and effective way of keeping one glued in through the rest of the often grueling narrative.    

One of the reasons that Fitzsimons succeeds in capturing the huge scale of the landings and subsequent battles while never losing sight of the plight of the common soldier is that Gallipoli itself is just the right size. Most important locations are a single hill, valley, or inlet. The enemy is always very close, the sounds of shrapnel and thud of artillery create a hellish sonic micro-climate, and the freshly dug cemeteries are never far off. The scenes feel both intimate and comprehensive, in a way that histories of Somme or Verdun can never be.

This text is recommended for readers who want to understand why such a massive undertaking seemed so poorly thought through and how victory was almost snatched from the jaws of defeat by the unyielding heroism of the average ANZAC. Read it to renew your appreciation for the military genius and iron willpower of the Ottoman commander, Mustafa Kemal – a figure whose obvious talent and ambition mark him out for even greater deeds after the War. Read it because it’s a crackling good yarn and a minor masterpiece of the genre.

Gibraltar: Legal Advice on Innocent Passage

While tensions over the South China Sea often prompt headlines, attracting a great deal of attention by analysts, the dispute over Gibraltar has a much smaller presence in the media and specialized publications. However, given its location at a vital chokepoint, the conflict over the Rock cannot be ignored by naval and maritime observers. Furthermore, for the student of comparative conflict at sea it is interesting to look at some of its features, including disputes over the law of the sea and resort to non-lethal asymmetric warfare, which we also find elsewhere. A third reason is Gibraltar’s role in the air reinforcement strategy for the defence of the Falklands, an issue that China watchers are increasingly paying attention to, given Beijing’s growing interest in the South Atlantic, including Namibia.

Just like in the South China Sea, one of the aspects of the dispute over Gibraltar concerns the concept of “Innocent Passage”. In the case of the Rock, intruding warships have often claimed to be engaged in this regime, recognized by international law, both customary and UNCLOS (United Nations Convention on the Law of the Sea). However, Gibraltar’s authorities have rejected such claims, arguing that they were a mere excuse to justify incursions into British Territorial Waters. In order to reinforce their case, Gibraltar’s government announced in November 2014 that it had commissioned an expert legal opinion on the definition of innocent passage under UNCLOS. The latest string of incidents prompted the Gibraltar Broadcasting Corporation (GBC) to ask the Rock’s authorities whether the opinion had been received, and they replied confirming it had. According to the GBC, the opinion explains that “A vessel can only be considered to be on innocent passage through British Gibraltar Territorial Waters if it’s moving continuously and expeditiously, and is not engaged in any activities that are prejudicial to Gibraltar or the UK”, adding that “when it appears objectively from the foreign vessel’s behaviour that its purpose in passing through BGTW is to assert its country’s sovereignty claim over the waters, its passage would not be deemed to be innocent under international law.”1

On reading the GBC report, Luke Coffey, Margaret Thatcher Fellow, Margaret Thatcher Center for Freedom, The Heritage Foundation, tweeted “Spain in violation of UNCLOS, Article19 (Meaning of innocent passage), paragraph 2C, 2D, 2J, probably 2K and 2L!!”.2 These passages of UNCLOS read:

Meaning of innocent passage

1. Passage is innocent so long as it is not prejudicial to the peace, good order or security of the coastal State. Such passage shall take place in conformity with this Convention and with other rules of international law.

2. Passage of a foreign ship shall be considered to be prejudicial to the peace, good order or security of the coastal State if in the territorial sea it engages in any of the following activities:

(c) any act aimed at collecting information to the prejudice of the defence or security of the coastal State;

(d) any act of propaganda aimed at affecting the defence or security of the coastal State;

(j) the carrying out of research or survey activities;

(k) any act aimed at interfering with any systems of communication or any other facilities or installations of the coastal State;

(l) any other activity not having a direct bearing on passage”.

It could also be argued that incursions into Gibraltar’s territorial waters amount to a violation of paragraph (a) of the mentioned UNCLOS article, which reads “ any threat or use of force against the sovereignty, territorial integrity or political independence of the coastal State, or in any other manner in violation of the principles of international law embodied in the Charter of the United Nations”, given that they take place in parallel with a denial of the British sovereignty over the Rock and her population’s right to self-determination.

However, innocent passage is a key concept in the law of the sea, and cannot be easily dismissed. Any attempt to deny that a warship moving through territorial waters enjoys it must be approached with care. This was made clear by James Kraska, a professor at the US Naval War College, who also commented on the Gibraltar report. Kraska stressed on Twitter that a “[t]hreat may not be implied based on mere presence, but must be overt, such as statement or action, such as fire control radar,” adding “See Jackson Hole Agreement; purpose of trip irrelevant; must have overt violation of art. 19 to be not innocent.”3 This refers to the 1989 USA-USSR Joint Statement With Attached Uniform Interpretation of Rules of International Law Governing Innocent Passage, known as “Jackson Hole Agreement”, whose text states that “All ships, including warships, regardless of cargo, armament or means of propulsion, enjoy the right of innocent passage through the territorial sea in accordance with international law, for which neither prior notification nor authorization is required”, in accordance with UNCLOS.

A difference between Cold War maritime confrontations and the dispute over Gibraltar is that in the former, it was the limits of innocent passage, which were disputed, ultimately leading to the 1989 Joint Statement. However, in the case of the Rock, vessels violating her territorial waters claim that those waters do not exist. Another difference to take into account is that while ramming featured in a number of incidents during the Cold War, the context was mainly a threat of conventional war at sea. On the other hand, what we are now seeing in regions like the South China Sea is mainly non-lethal warfare, featuring a complex mix of coastguards and other state agencies, fishing boats, maritime militias, and oil rigs. In Asia, this phenomenon is called the “gray zone” between peace and war. This does not mean that the conventional force is irrelevant, since what we are facing in the South China Sea is a dual war akin to the Second Indochina War on land. Concerning Gibraltar, the fact that intruding ships purport to conduct “sovereignty” patrols means that their passage is not innocent within the meaning of Article 19 of UNCLOS. The very purpose of those incursions is to undermine the “peace, good order, and security” of the territorial waters of the United Kingdom.

Could the legal opinion provided to Gibraltar’s Government have any influence on the legal dispute over the South China Sea? As is often the case, lawyers on both sides may find something to support their respective views. On the one hand, maritime democracies are bound to benefit from any obstacle to further incursions into British Territorial Waters, which not only run directly against the concept of rule of law at sea and peaceful resolution of disputes, but make it difficult for the European Union to play a role in the South China Sea. On the other hand, China may expand the notion that a warship moving through territorial waters is not engaged in innocent passage when making a territorial claim, arguing that neither is she when contesting a territorial claim. The challenge, however, remains how to distinguish lawful innocent passage, no matter how disliked by the coastal state, from genuine threats to “peace, good order, or security” of the coastal state. Kraska underlines that for this analysis, we must fall back on the Charter of the United Nations, which forbids the “threat or use of force.” A factor not to be forgotten is Beijing’s permanent seat at the UNSC, meaning that whatever interpretation of the UN charter may prevail among maritime democracies, it is unlikely to make it into a Security Council resolution if it is seen by China as detrimental to her national security. Recent months have seen many proposals concerning a reinforced presence by maritime democracies in waters claimed by Beijing in the South China Sea, and the airspace over them, as well as a number of incidents involving warships and planes in those same waters. The former include a study by Scott Cheney-Peters on joint air patrols, whose main purpose would be “to counter excessive claims and rights not in accordance with international law.”

It would be interesting to see the full text of the legal opinion commissioned by Gibraltar’s Government. In any case, the information released about it should serve as a reminder that in a global, inter-connected, world, each maritime dispute may certainly be unique, but it makes sense to study them from a comparative perspective, among other reasons because in both diplomacy (including public diplomacy) and international legal and arbitration proceedings, anything considered as a precedent may be used to defend one’s position.
